Burniston is situated on the edge of the North Yorkshire Moors and close to Yorkshires’ east coast, approximately 5km north of Scarborough and 25 km south of Whitby. Scarborough has a regular train service to York that in turn offers an excellent rail network both south to London and north to Newcastle and Scotland. There is also a station in nearby Filey. Town Planning

Outline planning permission for residential development with approved access and drainage (TP ref: 18/00505/OL) was granted on Appeal on 8 January 2019. The site is an allocated site in the adopted Scarborough Local plan with an indicative capacity of 40 dwellings

A Sec. 106 Agreement has been signed as part of the planning permission. The Sec. 106 agreement requires the following Planning Gain items (all based on a 36 unit scheme):

  • 30% of all units as affordable housing
  • £213,682.50 Education Contribution
  • £24,464.16 Children’s Play Facilities Contribution
  • £11,753.64 Parks and Gardens Facilities Commuted Sum
  • £7,171.20 Sports Facilities contribution

A Unilateral Undertaking has also been entered in to requiring the construction of a Headwall on the land edged blue on the Site Location Plan to mitigate ‘ponding’. Furthermore the Unilateral Undertaking requires Ecological Enhancement Works. Both requirements are to be maintained by a Management Company for 10 years prior to them being offered to Scarborough Borough Council for adoption.
